Step 2: NIA Evaluation Process
After the NIA researcher has completed and filed the NIA Invention Disclosure Form, the researcher will participate in a series of meetings that will focus on the contents of the invention disclosure form.
At the stage, NIA will be determining the following:
- Is the proposed invention novel?
- Is the proposed invention useful?
- Is the proposed invention non-obvious to one skilled in the art?
These three questions are reviewed utilizing the concept of “prior art” (the knowledge base that existed prior to the invention. In the event that NIA determines that the answer to these three questions is “yes”, then NIA will go to the next part of its evaluation process.
NIA will evaluate the invention to determine whether a third party would desire to commercially license the invention. In the event that the answer is “yes”, then NIA will review the invention and make an assessment as to whether or not the invention has the an excellent potential to be legally protected by the filing of the appropriate patent documents.
